Didi Fined Over 8 Billion Yuan. Now What?

On July 21, 2022, the Cyberspace Administration of China announced a decision to impose on DiDi Global Inc. (“Didi”) an “administrative penalty related to cybersecurity review”.  The bases for the penalty decision mainly include: the Cybersecurity Law, the Data Security Law, and the Personal Information Protection Law.  The massive fine amount was reportedly based on “a comprehensive consideration of the nature, duration, and harm of Didi’s violations as well as the circumstances [under which the violations were committed]”.  Is the fine that Didi is facing reasonable?  In the future, will this amount become a standard penalty and/or will it be referenced in similar cases or for similar companies?

Also, Didi is reportedly considering soliciting a state-owned enterprise to become a shareholder in order to gain the trust of the regulating institution and reduce regulatory risks.  What implications does this have for other companies?

2022年7月21日,中国国家互联网信息办公室公布对滴滴全球股份有限公司(“滴滴公司”)作出“网络安全审查”相关行政处罚的决定。处罚决定的依据主要包括:《网络安全法》、《数据安全法》和《个人信息保护法》。据报,巨额罚款是基于“综合考虑滴滴公司违法行为的性质、持续时间、危害及情形”等。滴滴公司面临的罚金数额是否合理?将来,该金额是否会成为标准罚款和/或是否会在类似案件或类似公司中作为参考?

此外,根据报道,滴滴公司考虑会引入国企股东,以获得监管机构的信任和降低监管风险。这对其他公司带来什么启示?
